“This week we will propose reforms to the Electoral Counting Act to protect the rule of law and ensure that future attempts to attack the integrity of presidential elections do not succeed,” Cheney and Lofgren published in Wall Street. An op-ed wrote in the Journal on Sunday.
Supporters of the bill say a floor vote will take place on Wednesday and be issued the text of the bill on Monday afternoon. The House Rules Committee has scheduled an important meeting on the law on Tuesday.
In their op-ed, Cheney and Lofgren outline four areas they hope their law can address.
The first would be to ratify the Constitution and clarify that the Vice President has “no authority or discretion to reject the official state electoral slate, delay the counting by any material means, or issue procedural decisions to the effect of such ”

The proposed law would also make it harder for lawmakers to raise objections to official electors submitted from states, arguing that Congress should not be a “court of last resort.” They argue that the objections should be considered by one-third of each House and retain the vote for a majority. Currently, only one House member and one senator are required to raise objections.
Third, Cheney and Lofgren say that governors should broadcast valid election results to Congress. They state that if a governor or any other official prevents this from happening, “presidential candidates should be able to sue in federal court to ensure that Congress receives a valid certificate of statehood.” He says that these cases should be done before the counting of electoral votes of the Congress.
And fourth, the law will address efforts to change that after the results of elections to state legislatures are certified and before they are sent to Congress, as happened in some battleground states in 2020.
“The Constitution assigns an important duty to state legislatures, to determine how states appoint their electors. But this should not be misread as allowing state legislators to retrospectively alter election rules to change results. to allow change,” write Lofgren and Cheney.
The bill would have to be reconciled with legislation proposed by a group of senators led by Republican Sen. Susan Collins of Maine and Democratic Sen. Joe Manchin of West Virginia, that was released in July,
